AN APPRAISAL OF THE KEY PROVISIONS OF THE NIGERIAN DATA PROTECTION ACT, 2023

Abstract

Technology transcends national borders, creating challenges for legislation that is
typically bound by geographic and jurisdictional limits. International coordination is
difficult and varying regulations across countries can complicate enforcement and
protection efforts. Legislation must however balance various interests, including
innovation, business needs, individual privacy and security. Finding this balance is
challenging, especially as technology introduces new ways to disrupt or complicate
these interests. The discourse around data protection law became more prominent in
this age of technological advancements. The Nigeria Data Protection Act of 2023 is one
of those laws necessitated by advancement of technology. It has become imperative to
appraise this law and analyze its scope, relevance, applicability and sustainability in
light of ever evolving technologies
